DPP Data Carrier (QR Code) Requirements
Key requirements from the EU Toys Regulation (Article 19) regarding DPP data carrier placement and display.
Q1: Where should the QR code be placed — on the product or the packaging?
The data carrier must be physically present on the toy itself as the primary rule. Only when this is not possible due to the size or nature of the toy may it be placed on the packaging or accompanying documents.
Article 19(7):
"The data carrier shall be physically present on the toy or on an affixed label. Where the size or nature of the toy does not allow it, it shall be affixed to the packaging, if any, or on documentation accompanying the toy."
Priority 1: On the toy itself or on a label affixed to the toy.
Fallback: Only if size or nature prevents placement on the toy → packaging or accompanying documents.
Q2: Does the QR code need to be displayed on websites for online sales?
Yes. The regulation explicitly requires that the data carrier be visible to consumers before purchase, including in cases of distance and online sales.
Article 19(7), second sentence:
"It shall be clearly visible to the consumer or other end users before any purchase and to market surveillance authorities, including in cases where the toy is made available on the market through distance sales."
Q3: What are the obligations for online sales channels?
Economic operators must ensure the data carrier is accessible to potential customers in online sales scenarios.
Article 19(12):
"The economic operator shall: (a) provide distributors and online marketplaces with a digital copy of the data carrier or the unique product identifier; and (b) provide the digital copy or a webpage link free of charge within 5 working days of receiving a request."
Regulatory timeline
DPPs are being phased in. Economic operators have at least 18 months transition.
